Yeah you need the disc in order for it to launch.
The GC boots using its internal OS, which only checks the disc. The disc tells the GC to look at the Hi-Speed Port, so you can actually take the disc out afterwards, but you'll need it every time you start it.

I have one without the disc, is there anyway to get a hold of the disc? As I can't see anyone selling the disc on Ebay or something with out the hardware.

That said, GC mini-DVDs are nigh impossible to burn since, IIRC, the data goes outside in, rather than inside out.
